Report on Wuxi Micro Research Case
BSA received information from an informant indicating that Wuxi Micro Research Co. Ltd (hereinafter referred to as ”Micro Research”) was suspected of using unlicensed software from CNC Software, Inc. BSA communicated with the informant through mail and telephone calls, and after asking CNC Software to do a license check, BSA decided to take action against Micro Research.
On February 26, 2003, on behalf of CNC Software, Inc., attorney You and attorney Xu filed a complaint to the Copyright Administration of Jiangsu Province where Micro Research is located. BSA petitioned the Jiangsu Copyright Administration not only to fine and punish Micro Research, but also order it to stop the infringement of CNC Software, apologize and promise not to infringe the copyright of CNC Software anymore, and compensate the copyright owner according to the quantity and value of the infringed software.
After accepting the complaint, Jiangsu Copyright Administration and Wuxi Copyright Administration carried out a raid on March 27, 2003. There were 2 sets of unlicensed software (Mastercam Mill level 3) found on two computers on the site of Wuxi Micro Research Co. Ltd.
After the raid, BSA had several rounds of negotiation with the target. And finally under the mediation of Jiangsu Copyright Administration, Micro Research apologized to CNC Software Inc. and promised not to use the illegal software anymore. On June 15, 2003, BSA signed the settlement agreement with Micro Research. According to the agreement, Micro Research agreed to buy licensed software immediately and deleted all the pirated Mastercam software. A financial settlement was also agreed upon.
